Birth injuries: Newborn fractures may not be apparent right away

All expecting parents worry about the health and physical condition of their unborn babies. Most of the time, this worry turns out to be unjustified, much to the relief of brand-new parents. Other times, the worst fears of parents come true and their newborn suffers medical problems, sometimes due to one or more birth injuries.

Bone fractures are relatively common types of birth injuries, especially when the delivery is difficult. However, fractures may go unnoticed by the labor and delivery team. According to one report, birth injuries often result in broken collarbones in newborns. In many cases, it is the baby's parents that discover the injury when they feel the beginning of callus formations near the fracture.

Other fractures that can happen during the delivery of an infant include the following.

  • Humerus (upper arm) fractures
  • Long bone (leg or arm bones) fractures
  • Epiphysis (located at the ends of long bones) fractures
  • Rarely, rib fractures may occur

We are parents as well as attorneys, so we understand how hard it is for you to imagine that your baby needlessly experienced pain for any length of time. Unfortunately, there exists a good chance that this is the case in birth injuries resulting in broken bones. The good news is that many newborn bones have not fused yet, meaning that your baby's fracture will likely heal quickly with the right care and treatment.

Some infant bone fractures may be unavoidable during particularly difficult births. However, medical negligence may play a role if the delivery team does not recognize the fracture and respond quickly to reduce suffering and prevent complications. Initiating a medical malpractice claim gives you a way to hold the parties responsible for your child's birth injury to account.
