Properly reporting nursing home abuse in New York

Those who come to us here at Futterman, Sirotkin, and Seinfeld with accusations of nursing home abuse are typically shocked to learn just how common this problem is. Yet what’s even more shocking is how widespread the issue could potentially be. According to information gather by The New York State Elder Abuse Prevalence Study, only one in every 25 cases of abuse is ever actually reported.

It may be difficult to pinpoint one particular reason why so many of these cases go unreported. One may assume that victims never come for forward because they’re embarrassed, they fear reprisals from their abusers, or they simply may be incapable of doing so. Yet another reason could be that the family and friends of abuse victims simply don’t know where to go to report it.

The immediate assumption may be to report it to the management personnel of the nursing home. While this certainly is an option, one should consider that the facility may likely choose to handle the matter internally rather than risk a hit to their reputation or possible sanctions from state regulatory agencies. If family and friends of abuse victims want assurances that the matter is being treated seriously, they may wish to instead go straight to those regulatory agencies themselves.

In the state of New York, the Department of Health handles all issues related to complaints against nursing homes and care centers. One simply needs to visit their website to fill out and submit an online complaint form with the following information:

  •          The residents name
  •          The name of the facility
  •          The details of the abuse

Submissions may be made anonymously should one so choose.
