New York leads the nation in medical malpractice payout

Residents in the state of New York have as much reason as citizens in the rest of the country to be concerned about the rate of doctor errors or other forms of medical malpractice. From birth injuries to surgical errors and beyond, the results of such situations can cause serious personal injuries or even death to victims. The law allows for affected parties to seek compensation when this happens, although the outcome can vary greatly.

A recent report was issued by Diedrich Healthcare that shows the number of payouts for medical malpractice claims to be far higher in the state of New York than in any other state in the nation--as much as 50 percent higher than the next state in the list. The report also indicated that the vast majority--96 percent--of all payouts received in 2013 resulted from settlements rather than from trial decisions.

Both the amount and the number of claims receiving payouts rose last year for the first time since 2003. The report was conducted for the National Practitioner’s Data Bank and only represented those claims that had been filed against individual practitioners, not against facilities such as hospitals or clinics. It also did not include any payout made without a formal written legal demand.

Doctor errors can happen for many reasons including understaffing, poor communication and more. No matter the reason, the need for victims to receive compensation remains the same.
