The New York Daily News is reporting on an extremely tragic event and subsequent wrongful death suit filed by a couple that claims their obstetrician-gynecologist was medically negligent during the birth of their child ultimately killing him. The couple claims in their suit that the doctor caused the baby’s head to separate from his body after he became stuck in the mother’s birth canal and the doctor tried to pull him out. But the story only gets worse from here.
The couple also claims that initially the doctor refused to perform a C-section and after he internally decapitated the child he attempted to cover up his mistake by trying to push the baby back into the womb in order to perform an emergency C-section. The details of this particular wrongful death complaint are absolutely horrifying. The alleged medical malpractice occurred in the spring of last year. In a late February 2011 appointment, the couple claims one doctor told them the baby would need to be delivered by C-section because his abdomen was too large for a normal vaginal birth.
In late March, the mother went into premature labor at 28 weeks. The doctor delivering the child at the Missouri hospital refused to perform the C-section and would only deliver the baby by attempting a vaginal birth first, according to the complaint filed. He also refused to allow the couple to transfer to a different hospital. It was only under duress and with protest did the couple agree to try a vaginal birth. The baby’s head became separated after the doctor tried to pull the baby out after he became stuck in the birth canal. In an attempt to cover up his mistake he allegedly hurried to perform the C-section by pushing the baby’s head back into the mother.
The doctor then proceeded to cut into the mother before anesthesia could kick in causing her further undue pain and suffering. The complaint also alleges that the doctor tried to cover up the baby’s injuries before transferring the child to his parents, exactly how was not disclosed. Apparently the baby’s neck was somehow cut during the initial vaginal delivery and blood was seen spurting from the child in full view of both parents. The parents are seeking unspecified damages in the wrongful death suit, which names several defendants, including the two doctors involved.
