The birth of a child should be an exciting time. New York parents should be able to enjoy the moment instead of worrying about insufficient care from their physicians. When doctors mishandle a labor and delivery, severe, life-changing birth injuries can occur. One family will have a constant reminder of how their joyous occasion turned into a nightmare.
A little girl now lives with a brain injury, which her parents claim will mean she will never be able to live on her own. It all began more than two years ago, when her mother was admitted to a hospital while in active labor. The parents noticed that the fetal heart monitor was giving signs of non-reassuring tracings, which the hospital's staff failed to recognize, according to a court complaint.
In the lawsuit, the parents state that the defendants - which include the hospital and a doctor - did not deliver the baby in a timely manner, which resulted in both a permanent brain injury and other injuries. The hospital error has, according to the parents, deprived them of the comfort of their daughter, among other things.
The family ended up reaching a settlement with the defendants, agreeing to release the hospital and others from liability.
