Lost form costs Staten Island hospital in malpractice lawsuit

When you make the decision to go to the hospital to receive treatment for a serious condition, the last thing that you hope for is to return to that hospital within days of your release because of a mistake made on the part of the hospital. Yet these kinds of events happen more often than you may realize and, when they do, it is important to hold that hospital responsible.

An older woman encountered just such hospital negligence when she was brought to Staten Island University Hospital with chest pains. According to legal documents filed with the court, the woman was given a stent during her stay in the hospital and her treatment included the drug Plavix.

However, when the woman left the hospital, her doctor did not give her a prescription for the drug, even though she had taken it before her admittance and at the hospital itself. The doctor error resulted in blood clots on the stent, inducing a massive heart attack eight days after her release. The woman filed a medical malpractice lawsuit against the hospital, asking for monetary damages.

The hospital's cardiologist claimed to have told the woman to continue taking Plavix. However, a hospital error apparently occurred: the document containing the list of medications prescribed to the woman was lost. As a result of the lost document, a judge ruled in favor of the patient, finding the hospital to be liable for the heart attack she experienced. The hospital may choose to appeal the verdict.

When something like this occurs, it is important to make sure that you speak with a medical malpractice attorney as soon as possible. You have legal rights when it comes to hospital errors and there is no need to suffer in silence.
